以下の規約は予告なく変更される可能性があります。以前の規約のもとで許諾を受けた方は、申請当時の規約が適用されます。

H/MIX GALLERY music is published for free use. These terms may be updated without notice. If you received a license under a previous version, those terms remain in effect for you.

申請なしで利用できる場合

• 個人・同人サークルによる作品（同人誌・同人ゲームなど）への使用
• YouTube への動画投稿（広告収益化・企業チャンネルを含む）
  ※ 動画の説明欄に H/MIX GALLERY へのリンク（https://www.hmix.net） を記載してください。
• 非商業コンテンツ・非営利団体の活動

商用ライセンスが必要な場合

• 商品・サービスのプロモーション映像・広告動画
• 企業VP・会社紹介映像・採用動画
• 楽曲コンテンツを含む商品（DVD・ゲーム・アプリなど）の販売
• 舞台・演劇・イベントでの商用BGM使用

禁止事項

• 楽曲ファイルの再配布・二次販売
• Spotify・Apple Music 等のストリーミングプラットフォームへの楽曲単体登録
• YouTube Content ID への楽曲登録（第三者への権利申立）
• NFT化・ブロックチェーン資産としての登録
• AI学習データとしての利用

Prohibited Uses

• Redistribution or resale of music files
• Uploading tracks as standalone releases to Spotify, Apple Music, etc.
• Registering tracks to YouTube Content ID to claim against others
• Minting as NFT or blockchain assets
• Use as AI training data

なお、H/MIX GALLERY からクレームを申請することはありません。

禁止事項

利用者が当サイトの楽曲をYouTube Content IDやFacebook/Instagram Rights Managerなどの権利管理システムに登録することは、他の正当な利用者に不当なクレームを発生させるため固く禁止します。

H/MIX GALLERY tracks are not registered with YouTube Content ID.
You should not receive any copyright claims for normal use of this music.

If you receive a claim

A third party may have registered the track without permission. Please contact us and we will help you file a dispute. H/MIX GALLERY will never file a claim against you.

Registering H/MIX GALLERY tracks to YouTube Content ID, Facebook/Instagram Rights Manager, or similar systems is strictly prohibited, as it causes wrongful claims against other legitimate users.

商用ライセンスは、購入者本人・購入時に指定した1プロジェクトにのみ有効です。

「1プロジェクト」の定義

• 同一タイトルの作品1つ（映像・ゲーム・アプリ等）
• 同一の広告キャンペーン1件
• シリーズ作品の各話・続編は別プロジェクトとして扱います
• 同一動画の画質違い（4K版等）は同一プロジェクトとみなします
• 制作会社がクライアントのために購入した場合、そのライセンスはクライアントの当該プロジェクトに帰属します

ライセンスの第三者への譲渡・転売・再許諾は禁止します。
購入者の事業譲渡・法人合併の場合は別途お問い合わせください。

Commercial licenses are valid only for the purchasing party and the single project specified at time of purchase.

Definition of "1 project"

• One title (video, game, app, etc.)
• One advertising campaign
• Each episode or sequel counts as a separate project
• Resolution variants of the same video (e.g. 4K) are considered the same project
• When purchased by a production company on behalf of a client, the license applies to that client's project

Transfer, resale, or sublicensing to third parties is strictly prohibited.
In cases of business transfer or corporate merger, please contact us.

H/MIX GALLERY は、以下について一切の責任を負いません。

• 本サイトの楽曲を利用したことにより生じた損害
• 第三者との著作権・肖像権・その他の権利に関する紛争
• 楽曲と第三者の既存著作物との類似性に関する問題
• システム障害・サーバー停止・データ消失による損害
• リンク先の外部サイトのコンテンツ・サービス

楽曲の利用はすべて利用者自身の責任において行ってください。

H/MIX GALLERY shall not be liable for any of the following:

• Any damages arising from the use of music on this site
• Disputes with third parties regarding copyright, portrait rights, or other intellectual property
• Any similarity between tracks and pre-existing works by third parties
• Damages caused by system failures, server downtime, or data loss
• Content or services of external linked sites

All use of the music is entirely at the user's own risk.

本規約は日本法を準拠法とします。本サイトの利用に関して生じた一切の紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from the use of this site shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
